{"id":149,"date":"2013-03-24T09:13:40","date_gmt":"2013-03-24T13:13:40","guid":{"rendered":"http:\/\/internetdistinction.com\/wsisimpacts\/?page_id=149"},"modified":"2020-09-09T07:59:52","modified_gmt":"2020-09-09T11:59:52","slug":"on-the-opinion","status":"publish","type":"page","link":"https:\/\/internetdistinction.com\/wsisimpacts\/on-the-opinion\/","title":{"rendered":"Synopsis of the Opinion"},"content":{"rendered":"<ul>\n<li><em><a href=\"http:\/\/www.itu.int\/md\/S13-WTPF13IEG3-C-0049\/en\" target=\"OtherPopup\" rel=\"noopener noreferrer\">Submission by the Internet Systems Consortium as a proposed opinion at the ITU<\/a><\/em><\/li>\n<li><em><a href=\"https:\/\/internetdistinction.com\/wsisimpacts\/on-the-opinion\/opinion-streamlined\/\" target=\"OnePopup\" rel=\"noopener noreferrer\">Streamlined web version of the Opinion<\/a><\/em><\/li>\n<li><em><a href=\"https:\/\/internetdistinction.com\/wsisimpacts\/on-the-opinion\/full-opinion\/\" target=\"OnePopup\" rel=\"noopener noreferrer\">Full Opinion with citations<\/a><\/em><\/li>\n<li><em><a href=\"https:\/\/internetdistinction.com\/wsisimpacts\/files\/2013\/03\/Opinion-on-Recognizing-the-Internet-in-the-Information-Society.pdf\" target=\"OnePopup\" rel=\"noopener noreferrer\">PDF version<\/a><\/em><\/li>\n<li><em><a title=\"Supporters Letter\" href=\"https:\/\/internetdistinction.com\/wsisimpacts\/support-letter\/\">Supporters letter<\/a><\/em><\/li>\n<\/ul>\n<h3 style=\"text-align: left;\">On the Opinion on Recognizing the Internet in the Information Society<\/h3>\n<p>The <a href=\"https:\/\/internetdistinction.com\/wsisimpacts\/files\/2013\/03\/Opinion-on-Recognizing-the-Internet-in-the-Information-Society.pdf\" target=\"OnePopup\" rel=\"noopener noreferrer\">Opinion on Recognizing the Internet in the Information Society<\/a> was submitted in January 2013 <a href=\"https:\/\/internetdistinction.com\/wsisimpacts\/2013\/01\/25\/opinion-submitted-to-state\/\" target=\"OnePopup\" rel=\"noopener noreferrer\">to the US Delegation<\/a> and in February <a href=\"http:\/\/www.itu.int\/md\/S13-WTPF13IEG3-C-0049\/en\" target=\"OtherPopup\" rel=\"noopener noreferrer\">to the Informal Experts Group<\/a> preparing <a href=\"http:\/\/www.itu.int\/en\/wtpf-13\/Pages\/report-sg.aspx\" target=\"OtherPopup\" rel=\"noopener noreferrer\">the Secretary-General&#8217;s Report<\/a> for the <a href=\"http:\/\/www.itu.int\/en\/wtpf-13\/\" target=\"OtherPopup\" rel=\"noopener noreferrer\">World Telecommunication\/ICT Policy Forum<\/a> on May 14-16, 2013.<\/p>\n<p>The Opinion observes that the <a href=\"http:\/\/groups.itu.int\/wsis-forum2012\/Information\/WSISOverview.aspx\" target=\"OtherPopup\" rel=\"noopener noreferrer\">framing documents<\/a> issued by the <a href=\"http:\/\/www.itu.int\/wsis\/index.html\" target=\"OtherPopup\" rel=\"noopener noreferrer\">World Summit for the Information Society<\/a> <a href=\"https:\/\/internetdistinction.com\/wsisimpacts\/on-the-opinion\/opinion-streamlined\/#NoInternetWSIS\" target=\"OnePopup\" rel=\"noopener noreferrer\">make very little use of the term &#8220;Internet,&#8221; and almost entirely use the term &#8220;ICTs&#8221; instead<\/a>.&nbsp; It also observes that the ITU Resolutions that provide the topical context for the WTPF <a href=\"https:\/\/internetdistinction.com\/wsisimpacts\/on-the-opinion\/opinion-streamlined\/#OtherTermsWTPF\" target=\"OnePopup\" rel=\"noopener noreferrer\">make extensive use of other terms such as &#8220;Telecommunications\/ICTs,&#8221; &#8220;IP-Based Networks,&#8221; and &#8220;Next Generation Networks.&#8221;<\/a> This pattern also applies generally to the 2010 WTDC and Plenipotentiary resolutions according to which the ITU is helping implement the WSIS project.<\/p>\n<p>The Opinion notes that both public policy decisions and particular technical systems deployed within World Summit for the Information Society initiatives <a href=\"https:\/\/internetdistinction.com\/wsisimpacts\/on-the-opinion\/opinion-streamlined\/#PolicyAndSystemsImpact\" target=\"OnePopup\" rel=\"noopener noreferrer\">have the potential to undermine the nature of the Internet platform<\/a> and stresses that <a href=\"https:\/\/internetdistinction.com\/wsisimpacts\/on-the-opinion\/opinion-streamlined\/#IdentifyKeyCharacteristics\" target=\"OnePopup\" rel=\"noopener noreferrer\">key characteristics that distinguish the Internet must&nbsp; be articulated<\/a>, thereby allowing the impact of WSIS initiatives on the special nature and strengths of the Internet to be recognized and addressed.<\/p>\n<p>It calls attention to <a href=\"https:\/\/internetdistinction.com\/wsisimpacts\/on-the-opinion\/opinion-streamlined\/#NeedToRecognize\" target=\"OnePopup\" rel=\"noopener noreferrer\">the need to assure that both the governance and development contexts can readily recognize these impacts<\/a> in order to assure the advantages of the Internet are not overlooked without recognizing the tradeoffs that may be brought by various other technological solutions.<\/p>\n<p><a href=\"https:\/\/internetdistinction.com\/wsisimpacts\/on-the-opinion\/opinion-streamlined\/#KeyCharacteristics\" target=\"OnePopup\" rel=\"noopener noreferrer\">It proposes the following key characteristics<\/a> to help provide the basis for determining when Information Society initiatives relate to the Internet or not, whether for better or for worse:<\/p>\n<ul>\n<li>that it is defined in terms of principles of interoperation between networks,<\/li>\n<li>that the resulting platform is a general purpose platform,<\/li>\n<li>that it is available as a general purpose platform to end users, and<\/li>\n<li>that it enables general purpose connectivity directly between end  users throughout the globe (or beyond), to all other networks that  interoperate on the same terms.<\/li>\n<\/ul>\n<p>While it illustrates how terms that may mislead are being used in the founding documents and the implementing resolutions of the Information Society, the Opinion also provides brief clarifying references addressing how a failure to delineate the Internet in its own nature will open up the potential for the WSIS to undermine it, from the standpoints of governance, public policy initiatives, and development.<\/p>\n<p>The Opinion notes that almost every aspect of the <a href=\"http:\/\/www.itu.int\/wsis\/docs\/geneva\/official\/poa.html\" target=\"OtherPopup\" rel=\"noopener noreferrer\">Geneva Action Plan<\/a> <a href=\"https:\/\/internetdistinction.com\/wsisimpacts\/on-the-opinion\/opinion-streamlined\/#AllICTsWSIS\" target=\"OnePopup\" rel=\"noopener noreferrer\">is given in terms of &#8220;ICTs,&#8221;<\/a> and <a href=\"https:\/\/internetdistinction.com\/wsisimpacts\/on-the-opinion\/opinion-streamlined\/#GenevaActionPlan\" target=\"OnePopup\" rel=\"noopener noreferrer\">has the potential to affect the Internet unless the key characteristics of the Internet are recognized<\/a>.&nbsp; These are public policy areas relevant to the Internet which relate to both governance and development.&nbsp; <a href=\"https:\/\/internetdistinction.com\/bricoleur\/2013\/01\/07\/prepare-sec-gen-wtpf-opinions\/#ICTsFrame\" target=\"OnePopup\" rel=\"noopener noreferrer\">Recent CSTD proceedings reflect this same pattern<\/a> of using the general term &#8220;ICT&#8217;s&#8221; and making almost no reference to the Internet as such.<\/p>\n<p>The opinion acknowledges that <a href=\"https:\/\/internetdistinction.com\/wsisimpacts\/on-the-opinion\/opinion-streamlined\/#GovernmentsNotAllInternet\" target=\"OnePopup\" rel=\"noopener noreferrer\">not all governments will offer communications that qualify as Internet, and some governments will wish to provide for full Internet connectivity<\/a>, even as inter-governmental and national policies, including those contributing to the enabling environment for fostering telecommunications\/ICT development, as well as particular technological solutions promoted, may diverge from the characteristics that define the Internet.&nbsp;
